Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

• Under the Partial Cash on Delivery (COD) payment option, the partial payment amount submitted by the customer shall be non-refundable. By selecting this option, the customer acknowledges and agrees that any partial payment made prior to delivery is final and irrevocable. This provision applies regardless of order cancellation, return, or refusal of delivery.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

• We are not responsible if information made available on this site is not accurate, complete or current. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

• In no case shall SoulCircle India, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

• You agree to indemnify, defend and hold harmless SoulCircle India and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY

• In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION

• The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

• These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

• If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

• The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

• These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

SECTION 20 - STORE CREDIT

These Terms and Conditions ("Terms") govern the issuance, use, and management of Store Credit on the SoulCircle India platform (the "Platform"). By accepting or using Store Credit, you agree to be bound by these Terms.

1. General

• 1.1. What is Store Credit? Store Credit is a non-monetary credit issued by SoulCircle India to a customer's account. It can be used as a payment method for purchasing products available on the SoulCircle India store.

• 1.2. No Cash Value: Store Credit is not legal tender, has no cash value, and cannot be redeemed for cash or withdrawn to a bank account under any circumstances.

• 1.3. Non-Transferable: Store Credit is linked to the individual customer account to which it was issued. It is strictly non-transferable and cannot be sold, gifted, or assigned to any other person or account.

2. Issuance of Store Credit

Store Credit will be issued at the sole discretion of SoulCircle India in the following situations:

• 2.1. Returns:

• For eligible products returned within the 7-day return window, Store Credit equivalent to the value of the returned item(s) will be issued to your account instead of a refund to the original payment method.

• If a product is found to be defective or damaged upon delivery, a full Store Credit refund will be issued upon successful processing of the return.

• Partial returns of an order will result in a partial Store Credit being issued for the value of the specific product(s) returned.

• 2.2. Exchanges:

• If the customer wish to exchange a product for a lower-priced item, the customer may be offered Store Credit to cover the price difference at Maskyeti’s discretion.

• 2.3. Prepaid RTO (Return to Origin):

• For prepaid orders that are returned to us because they were undelivered or refused at the destination, Store Credit for the order value will be issued to the customer’s account. This will be processed approximately 7 days after the RTO is initiated and will be subject to deductions for any applicable shipping charges or penalties.

• 2.4. Promotional & Marketing Campaigns:

• SoulCircle India may issue promotional Store Credit as part of marketing campaigns. Such credits will be subject to specific terms, including shorter expiration periods (e.g., 3 days), which will be clearly communicated during the campaign.

• 2.5. Customer Service & Goodwill Gestures: Store Credit may be issued as a gesture of goodwill in various situations, at the sole discretion of Maskyeti.

3. Using Your Store Credit

• 3.1. At Checkout:

• You can use your available Store Credit balance to pay for all or part of your order at the checkout page.

• If your order total is less than your Store Credit balance, the remaining credit will be saved in your account for future use.

• If your order total exceeds your Store Credit balance, you must pay the remaining amount using another accepted payment method (e.g., credit/debit card, UPI, digital wallet).

• 3.2. Application: Store Credit will be applied to the final cart value and no discount coupons or promotional codes will be applied when store credit is used.

• 3.3. Minimum Purchase: SoulCircle India reserves the right to implement a minimum purchase value for the redemption of Store Credit. Any such requirement will be communicated on the platform.

4. Expiration of Store Credit

• 4.1. Standard Expiration: Unless specified otherwise (e.g., for promotional credits), Store Credit is valid for a period of 3 (three) months from the date of issuance.

• 4.2. Promotional Expiration: Promotional credits may have a shorter validity period (e.g., 3 days). The specific expiry date will be communicated at the time of issuance.

• 4.3. Expiration Notifications: We will attempt to notify the customer via email and/or in-app notifications 30 days before the standard Store Credit balance is set to expire. It is the customer’s responsibility to monitor your account and use the credit before it expires.

• 4.4. Credit from Cancelled Refunded Orders: If an order paid for using Store Credit is cancelled or returned, the amount of Store Credit used will be refunded back to the customer’s Store Credit balance. 

5. Visibility and Management

The customer can view their current Store Credit balance, a detailed transaction history (credits issued and used), and the expiry dates of the credits in the "My Account" section of the SoulCircle India store.

6. Guidelines and Restrictions

• 6.1. Policy Abuse: SoulCircle India reserves the right to suspend, revoke, or restrict Store Credit privileges for any customer found to be abusing the return, RTO, or cancellation policies. Repeated refusal of prepaid deliveries may lead to restrictions on future transactions.

• 6.2. Refunds to Original Payment Method: In specific cases where you request and are approved for a refund to your original payment method instead of Store Credit, the refund will be processed accordingly, and no Store Credit will be issued for that transaction.

• 6.3. Disputes: Any disputes or discrepancies regarding your Store Credit balance must be reported to our Customer Service team for investigation.

7. Modification of Terms

SoulCircle India reserves the right to modify, suspend, or terminate the Store Credit program or these Terms and Conditions at any time, with or without notice. Any changes will be updated on this page and will be effective immediately. Continued use of the Store Credit program after any such changes constitutes your acceptance of the new Terms.
